Waterlings

Waterlings is a registered business name of In The Deep Swim School Pty Ltd (ABN 76 158 704 217). In this policy, "Waterlings", "we", "us" and "our" mean that company. "You" means anyone who visits waterlings.com, buys from us, signs up to hear from us, or contacts us.
We take your privacy seriously. This policy explains what personal information we collect, why we collect it, who we share it with, and how you can access it, correct it or ask us to delete it.
We handle personal information in line with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles. If you are in the United Kingdom or the European Union, or in the United States, the sections near the end of this policy set out your additional rights.
1. The short version
- We collect the information we need to get your swim nappies, rashies and wet bags to you and look after you afterwards: your name, contact details, delivery address and order history.
- Our website and our ads use cookies and similar tools to understand what people look at and to show you our products.
- We only email or text you marketing if you have asked us to, and you can stop it any time.
- We never sell your personal information.
- Some of the services we use, like our website platform and our email platform, store information overseas.
- You can ask us what we hold about you, ask us to fix it, or ask us to delete it, by emailing hello@waterlings.com.
The rest of this policy is the detail behind those points.
2. What personal information we collect
When you buy from us
- Your name, email address and phone number
- Your billing and delivery addresses
- Your order details, including what you bought, sizes and quantities
- Payment confirmation details. Card payments are processed by our payment providers, and we never see or store your full card number
- Any delivery notes or gift messages you give us
When you contact us or ask a question
- Your name and contact details
- Whatever you tell us in your message, including any photos you send us about a product
When you sign up to our emails or texts, enter a giveaway, or join a waitlist
- Your name, email address and, if you give it to us, your mobile number
- Sometimes information you choose to give us about your child, such as their age, weight or size, so we can help you choose the right fit
- Your marketing preferences and whether you have opened or clicked our emails
When you leave a review or tag us
- Your name or the name you choose to display, your review, and any photos you send us
- If you tag us on social media, the content you have made public. We ask before we reshare it
When you visit waterlings.com
- Your IP address, device type, browser, operating system and rough location
- The pages you look at, what you add to your cart, and how you found us
- Cookie and pixel identifiers, as set out in section 5
If you are a stockist, supplier or apply to work with us
- Your business name, ABN, contact details, and the information you give us in your application or enquiry
Children. Waterlings makes reusable swim nappies, rashies and wet bags for babies and small children, but our website is for adults. We do not knowingly collect personal information directly from children. If a parent or carer gives us details about a child, such as an age or a size, we use them only to help with sizing and to fill the order. If you believe a child has given us their information, email us and we will delete it.
Sensitive information. We do not ask for sensitive information, such as health information, and you should not send it to us. If you do tell us something sensitive, for example a skin sensitivity affecting a fabric choice, we use it only to answer you and we do not add it to any marketing list.
3. How we collect it
Most of the time, you give it to us: at checkout, in an email, in a form, in a message on social media, or in person at a market or at the pool.
We also collect information automatically when you use our website, through cookies and similar technologies.
Sometimes we receive information about you from others:
- Our website and payment platforms, when they confirm an order or flag a payment risk
- Delivery carriers, when they update us on where your parcel is
- Advertising and analytics platforms, which tell us in aggregate how our ads performed
- A stockist or retail partner, if you have asked them to pass on an enquiry to us
If we collect your information from someone else, we take reasonable steps to make sure you know we have it and why.
You can browse waterlings.com without telling us who you are. You can also deal with us anonymously or under a pseudonym when you make a general enquiry. We cannot fill an order anonymously, because we need a real name and address to deliver it.
4. Why we collect and use it
We use your personal information to:
- Take and fill your order, take payment, and deliver it to you
- Keep you updated on your order and handle returns, exchanges and warranty claims
- Answer your questions and look after you as a customer
- Send you marketing about our products, where you have asked to receive it
- Understand what people look at on our website so we can improve it and improve our products
- Run and measure our advertising, including showing our products to people like you
- Manage stockist, wholesale and supplier relationships
- Keep proper business records and meet our obligations under Australian tax, consumer and product safety law
- Protect our business against fraud, chargebacks and misuse of our website
We do not sell your personal information, and we do not rent or trade our customer list.
5. Cookies, pixels and tracking
Our website uses cookies, which are small files stored on your device, and similar tools like pixels and tags. They do a few different jobs:

6. Who we share it with
We share your personal information only with the people and services that help us run Waterlings, and only with what they need. They are all required to keep it secure and to use it only for the job we have given them.

We add and change apps as the business grows. When we do, we choose providers who commit to protecting your information, we give them only what they need for that job, and we update this policy when the change is a significant one.
We may also disclose personal information where the law requires it, where we need to enforce our terms, or if our business is sold or restructured. If that last one ever happens, your information passes to the new owner on the same terms as this policy.
7. Sending information overseas
Because we use the services listed above, and because we ship to customers overseas, your personal information may be disclosed to recipients outside Australia. The main countries are the United States, Canada, the United Kingdom, Ireland and countries in the European Union. Our delivery partners also receive your name and address in whichever country we are sending your parcel to.
Before we disclose personal information overseas, we take reasonable steps to make sure the recipient handles it consistently with the Australian Privacy Principles, usually through the contract we have with them.
8. Marketing, and how to stop it
We send marketing emails and texts only to people who have asked for them, for example by subscribing at checkout, entering a giveaway, or joining a waitlist. Every marketing email has an unsubscribe link at the bottom, and you can reply STOP to a marketing text. You can also just email us and we will take you off the list.
Unsubscribing from marketing does not stop the emails we have to send about an order you have placed, such as your confirmation and your tracking.
9. Keeping it safe
We hold personal information in secure, access-controlled systems run by us and by the providers listed above. We use encrypted connections on our website, we limit access to the people who need it, and we use multi-factor authentication on our key accounts.
No system is perfect. If a data breach happens that is likely to cause you serious harm, we will notify you and the Office of the Australian Information Commissioner as required under the Notifiable Data Breaches scheme.
10. How long we keep it
We keep personal information only as long as we need it:
- Order and financial records: seven years, as Australian tax law requires
- Customer and marketing contacts: while you are subscribed, and for a reasonable period after, unless you ask us to delete you sooner
- Website analytics: usually in aggregate, and for the retention period set by the analytics tool
- Enquiries that do not lead to an order: generally two years
When we no longer need personal information, we destroy it or de-identify it.
11. Automated decision-making
We do not use automated decision-making or artificial intelligence to make decisions that significantly affect your rights or interests.
Our checkout provider does apply automated fraud screening to orders, which can flag a payment as high risk. If an order is ever cancelled on that basis, a person at Waterlings reviews it first, and you can contact us to have it looked at again.
12. Getting access to your information, or having it corrected or deleted
You can ask us to:
- Tell you what personal information we hold about you
- Give you a copy of it
- Correct anything that is wrong or out of date
- Delete it, where we are not required to keep it
Email hello@waterlings.com with your request. We may ask you to confirm who you are before we act, so that we do not hand your information to somebody else. We will respond within 30 days. Access is free, though we may charge a reasonable cost if a request takes significant work, and we will tell you before we do.
If we cannot give you access or make a correction, we will explain why in writing.
13. Complaints
If you think we have mishandled your personal information, please tell us first. Email hello@waterlings.com, or write to us at 558A Anzac Parade, Kingsford NSW 2032, Australia, with "Privacy complaint" in the subject line.
We will acknowledge your complaint within 5 business days and give you an answer within 30 days. If we need longer, we will tell you why.

14. If you are in the United Kingdom or the European Union

You have the right to access your information, have it corrected or erased, restrict or object to how we use it, receive it in a portable format, and withdraw consent at any time. To exercise any of these, email hello@waterlings.com.
Your information is transferred to Australia and to the other countries listed in section 7. Where required, we rely on standard contractual clauses or an equivalent safeguard for those transfers.
You also have the right to complain to your local supervisory authority. In the UK, that is the Information Commissioner's Office at ico.org.uk. In Ireland, it is the Data Protection Commission at dataprotection.ie.
15. If you are in the United States
Depending on where you live, you may have the right to know what personal information we have collected about you, to request a copy of it, to ask us to delete it, and to opt out of the sale or sharing of personal information for targeted advertising.
We do not sell personal information for money. Our use of advertising cookies may count as "sharing" for targeted advertising under some state laws, including in California. You can opt out by turning off advertising cookies in your browser or by emailing us at hello@waterlings.com. We will not treat you differently for exercising any of these rights.
16. Changes to this policy
We update this policy when our business or our systems change. The current version always lives at waterlings.com/policies/privacy-policy, with the date it was last updated at the top. If we make a significant change, we will say so on our website or by email.
